Terms of service

These terms are the agreement between you and Red Swift Systems Ltd, registered in England and Wales under company number 14891467, with its registered office at 2nd Floor College House, 17 King Edwards Road, Ruislip, London HA4 7AE, United Kingdom, which operates Mixify. Using Mixify means accepting them.

What Mixify is

A place to find cocktails, to record the ones you drink, and — this is the part that matters — to see credit reach the people who invented them. Attribution is the product, not a feature of it.

Age

You must be at least 18 years old, or older if the law where you are says so, to hold an account. You can browse without one. Logging a drink requires an account, and that is deliberate.

Nothing here is an encouragement to drink. Recipes describe how a drink is made, not how much of it anyone should have.

Your account

Keep your password to yourself and tell us if you think somebody else has it. You are responsible for what happens under your account. If you sign in with Apple or Google, the security of that account is the security of this one.

One person, one account. Accounts representing a brand or a business are for that organisation and the people it authorises.

What you post

You keep ownership of what you create. You give us a non-exclusive, worldwide, royalty-free licence to store, display and distribute it as part of running Mixify, including showing it to people who have not signed in, and including in the mobile apps.

You are telling us that it is yours to post: that you wrote the text, that you have the rights to any image you upload, and that publishing it does not breach somebody else’s rights or an agreement you are under — including with an employer or a venue.

A recipe as a list of ingredients and proportions is generally not something anyone can own. The words you write around it, and the photographs you take, are. Please respect that distinction in both directions.

Attribution and contributions

Mixify records who created a drink and who has contributed to it since. Those records are the point of the service, and they are not private drafts: if you publish a recipe and later delete your account, the attribution record of who invented it can survive, because rewriting the history of a drink to reflect who still has an account would make the whole thing worthless.

Where a drink is a recognised classic, we attribute it as such. We do not claim, and you should not claim, invention of something that predates us both.

Behaving

• Do not post anything unlawful, abusive, harassing, or designed to deceive people about who created a drink.
• Do not claim someone else’s work as yours, and do not misrepresent a professional credential you do not hold.
• Do not scrape, overload, or attempt to break the service, or use it to send people unsolicited messages.
• Do not use Mixify to market alcohol to people who are under age.

Brands and sponsorship

Brands may run campaigns and sponsor recipes. Where a placement is paid for, it is marked as such. Payment can affect prominence; it does not change who is recorded as having created a drink, and it never will.

Money

Some features involve payments between people — tipping a bartender, for example. Where they are live, they are subject to their own terms shown at the time, and the payment itself is handled by a payment provider rather than by us. Nothing on Mixify is financial advice.

Ending it

You can close your account whenever you like; see the privacy notice for what happens to your data. We can suspend or close an account that breaks these terms, and we will tell you why unless we are not allowed to.

What we do not promise

Mixify is provided as it is. We do not promise it will be uninterrupted or free of errors, and we do not warrant that a recipe someone else posted is accurate, safe, or suitable for you. Check your own allergens and know your own limits.

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to exclude. Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, goodwill or data.

If you are a consumer, you keep every right the law gives you and nothing here reduces them.

Changes

These terms carry a version and a date, both at the top of this page. We will give notice of material changes rather than replacing the text quietly.

Law

These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you are a consumer resident elsewhere, you keep the protection of the mandatory law of the place you live.
